1. Acceptance

By accessing or using esek.io ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

esek.io provides a web-based platform that allows businesses to manage customer conversations via the WhatsApp Business API, including AI-assisted replies, appointment booking, and media exchange.

3. Eligibility

You must be at least 18 years old and legally authorised to act on behalf of any business entity you register. By using the Service you represent that these conditions are met.

You agree not to use the Service to:

Fair use (AI and lead volume). Where a plan advertises “unlimited leads,” that allowance covers normal human business operations. Automated spam, bot attacks, or sustained usage exceeding 3,000 AI interactions per month per account may be paused for review. We may enforce technical limits (including rate limits) to protect the platform and third-party API costs.

6. WhatsApp Business API Compliance

You are solely responsible for complying with Meta's WhatsApp Business API terms and policies when using the Service to communicate with end users.

7. Intellectual Property

The Service and its original content (excluding user-generated data) remain the exclusive property of esek.io. You retain ownership of any content you upload or transmit through the Service.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. We do not warrant uninterrupted, error-free operation.

9. Limitation of Liability

To the fullest extent permitted by law, esek.io shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service.

10. Fees, plans, and subscription periods

Published prices and plan descriptions on our website or at checkout are an invitation to subscribe. The fees, limits, and features that apply to your current prepaid subscription period (for example a monthly or annual term you have already paid for) are those you agree to at checkout or in your order confirmation for that period.

Renewals. When a period ends, any renewal is a new offer. We may invite you to renew on updated prices, limits, or terms. If you do not agree, you may decline to renew. Where applicable law requires notice or consent for price or other material changes, we will follow it.

11. Changes to these terms

We may update these Terms of Service from time to time. For subscribers with an active prepaid period, changes that materially disadvantage you generally apply from your next renewal unless applicable law requires otherwise or you accept an update earlier (for example by clicking to accept in the product). We may still make changes required for legal, security, or compliance reasons, with reasonable notice where practicable.

After we post an updated version, continued use of the Service means you accept the updated terms for new subscriptions and activity; obligations for a period you have already paid for are governed by the terms in effect when you paid, except as required by law.
